1. Binding Agreement & Acceptance

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “Client,” “Patient,” or “you”) and Red Carpet Aesthetics, operating in conjunction with Trifecta Med Spa (“Practice,” “we,” “us,” or “our”).

By accessing our website (https://redcarpetaesthetics.com), scheduling an appointment, purchasing aesthetic packages, or receiving treatments at our facility located at 30 E. 60th Street, Suite 2503, New York, NY 10022, you expressly agree to be bound by these Terms, our Privacy Policy, and any in-office clinical informed consent documents. If you do not agree to all terms, do not use our services or website.

3. Mandatory Clinical Consultation & Informed Consent

All clinical aesthetic treatments are subject to prior medical evaluation and suitability determination by our licensed medical staff. We reserve the absolute right to refuse or discontinue treatment to any individual if our providers determine that a procedure is clinically contraindicated, unsafe, or inappropriate.

Prior to receiving any treatment, patients must sign a procedure-specific Informed Consent Form detailing potential risks, anticipated downtime, side effects (such as bruising, swelling, erythema, asymmetry, or rare vascular complications), and post-treatment maintenance.

4. Appointment Booking, Rescheduling & Cancellation Policy

Because our medical providers and treatment suites are reserved exclusively for you, we strictly enforce our appointment and cancellation policies:

• Deposit Requirements: A valid credit card or nominal deposit is required to reserve any appointment or consultation.
• 24–48 Hour Cancellation Notice: We require at least 24 hours advance notice (48 hours for multi-service or high-duration appointments) to cancel or reschedule without fee.
• Late Cancellations & No-Shows: Appointments cancelled with less than the required notice or missed entirely (“no-show”) are subject to a non-refundable cancellation fee or forfeiture of the appointment deposit.
• Late Arrivals: If you arrive more than 15 minutes late, your treatment duration may be shortened or rescheduled to avoid inconveniencing subsequent patients, with standard late fees applicable.

5. Pricing, Package Expirations & No-Refund Policy

• All Treatments Are Final Sale: Due to the nature of aesthetic medical services and single-use clinical supplies, all services, treatments, injectable vials, and package sessions are non-refundable once administered or purchased.
• Package Expirations & Transfers: Multi-session packages (e.g., laser hair removal series or facial packages) are valid for 12 months from purchase date and are non-transferable to other individuals without prior written management approval.
• Price Revisions: Prices displayed on our website or promotional materials are subject to change without prior notice. Custom quotes provided during consultations supersede published web rates.

7. Dispute Resolution, Mandatory Arbitration & Class Action Waiver

Mandatory Binding Arbitration: You and Red Carpet Aesthetics agree that any legal dispute, controversy, or claim arising out of or relating to these Terms, our website, or services provided shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) in New York County, New York, rather than in court.

Class Action Waiver: YOU AND THE PRACTICE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

8. Intellectual Property & Website Content

All trademarks, logos, service marks, copy, before-and-after imagery, and digital designs displayed on this website are the proprietary property of Red Carpet Aesthetics and Trifecta Med Spa or their respective licensors. Unauthorized reproduction, distribution, scraping, or commercial exploitation is strictly prohibited and will be prosecuted under federal copyright and trademark laws.
